According to a Kingstree Police Department incident report, on Friday, June 13, 2008 at approximately 6:30 p.m. Kingstree Police officers observed a silver van run a stop sign while traveling down Singleton Ave. in Kingstree. Officers followed the van to further observe subject’s driving. When the driver of the van pulled into Gilland Park and stopped, officers approached the van and asked the driver for his license and registration. The driver of the van was identified as David C. Patterson, 19, of 77 McKenzie Street, Kingstree.
Officers reported that Patter-son appeared nervous. At that time they noticed a “green leafy substance” they believed to be marijuana scattered on the passenger’s seat as well as the floor of the van. Officers then asked if they could search the van and the driver complied. When asked why he had come to the park, Patterson replied he was there to meet someone to buy marijuana. Officers reported that a cell phone in the van kept ringing with the name “Frank” showing up on the caller I.D. The subject refused to answer the phone. Officers then asked Patterson if they could answer the call and he agreed.
When the officer answered the caller said, “Where are you at now?” The officer stated he said “at the park.” The caller said he was on the way. The officer said he could hear a lot of wind in the phone and assumed the caller was riding with his windows down.
An officer was requested to wait on Singleton Avenue to watch for a black male driving with windows rolled down and reported to the officer waiting in the park as soon as he saw someone fitting that description approach.
As the vehicle entered the park he was stopped by officers and asked to show his I.D. Officers noticed the name on his driver’s license was Frank C. Washington, Jr.
After determining that this was the same Frank that the officer had spoken to from Patterson’s phone, officers asked Washington if they could search his vehicle, but he refused.
The report then states that at that time a K-9 unit was called in. Upon arrival, the K-9 was led around the vehicle, where he then alerted officers to the presence of marijuana. Washington was then asked to step out of the vehicle and a search was conducted.
According to the report, during the search a large quantity of a “green leafy substance” was found under the driver’s seat of the vehicle. Washington was then placed under arrest. The search yielded cash totaling $354 in $5s, $10s, and $20s, that was found on the suspect and in the console of the car. The weight of the substance believed to be marijuana, found in the vehicle, was 15.6 ounces.
Washington was charged with possession with intent to distribute within the proximity of a school, park, or playground, and possession of drug paraphernalia, a small scale.
Patterson was charged with party to a crime under town ordinance and released. Patter-son had cash totaling $130 for the purpose of purchasing marijuana. The cash was turned over to the police department voluntarily by the subject.
